http://chic.clipsyndicate.com/video/playlist/12492/7357289?cpt=8&wpid=2637 Mon, 14 May 2018 03:35:54 +0000 LawCall: Bench and Jury Trials The difference between having a jury on your trial and leaving it up to the judge to make decisions. http://chic.clipsyndicate.com/video/playlist/12492/7357289?cpt=8&wpid=2637 WAAY ABC Huntsville, AL trial. and we'll answer some of your email questions. will league from siniard, timberlake & league is here and i understand -- so if i go to court, i always get my peers to decide what is for me. >> will league: right. majority of the trials have juries. federal court you have to have six. in state court, alabama court, it's 12. most of the time it has to be unanimous, depending on what type of case, but a bench trial is used every now and then and the judge decides the verdict, not a jury. oftentimes the sides can agree. if you file a lawsuit you can request a jury trial or you don't have to request a jury trial and go to a bench trial and the judge can decide it. oftentimes there's questions of law that may be more suitable for a judge to decide, and oftentimes the parties can stipulate that a judge decide this particular case as opposed to a jury. and so it's beneficial to both sides depending on what type of content the judge is going to decide, if the judge has a particular area of expertise in that particular area of law, you may want to utilize that because some of these things can get complicated and if the judge has that background, the sides can agree to use them. and so it's -- you know, juries, judges, you get to a decision, you know, either one of those ways. >> robert lane: but i get to decide if it's a judge or a jury or the judge gets to decide? >> will league: if you file your case, robert, you can request a jury. if you don't request it, the other side can request a jury. whoever wants one gets one or the parties can
