Midwest Can Reaches Agreement with the EPA on Emissions Testing

FRANKLIN PARK, Ill.–(BUSINESS WIRE)–Midwest Can Company, LLC (“Midwest Can”), an Illinois-based manufacturer of portable fuel containers (“PFCs”) for the safe handling, usage and storage of flammable liquids, today announced that it has reached an agreement with the Environmental Protection Agency (“EPA”) regarding two product lines that were previously discontinued. The settlement relates to alleged Clean Air Act violations for emissions testing initially conducted in 2008 and early 2009 in the infancy of the federal PFC emissions testing program when the industry and EPA-certified laboratories were working to put the new testing protocols into practice.

The action does not allege safety standard violations, and the EPA is not requiring users to take any action with regard to Midwest Can portable fuel containers.

While expressly denying the allegations in the complaint and admitting no liability, Midwest Can has agreed to pay a $1.7 million fine under the settlement agreement and to perform two additional rounds of emissions testing for its portable fuel containers. By resolving these legacy allegations now, Midwest Can avoids potentially protracted and costly litigation.

As always, Midwest Can remains focused on the safe handling, usage and storage of flammable liquids in its line of gasoline, kerosene, and diesel fuel containers, funnels, drain pans, and related accessories.
